2020.09.30 04:55 drywitforbrains (Tenant) California Non-COVID 60 day Move-Out Notice Given, Guidance Requested!

Hi Redditors! In mid-August of this year, I (38F) was given a 60-day move-out notice by California landlord (70M). He is exemption the Just-Cause Eviction law passed in Calif at the end of last year, but from I understand, he's supposed to include specific language informing me of such and he did not. It just said I had to move, with no cause given.
This notice came several days after I told his wife he has been regularly making sexually appropriate remarks to me (i.e the latest being, "A young woman out here all alone must have needs...") and that he has been grooming my two young daughters (11 and 5 years). He lives nextdoor and is nosy every time something happens in my household like a vehicle gets towed away, or a guest comes by; acts like he is the lord of the manor, entering my yard often to fuss with something (he leaves piles of lumber around my yard for this purpose) and makes comments to my children about how pretty my/ their bodies are (he creeps ALL the women in the community out, and he has nude photos of he daughters as minor teens on his hallway wall, calls 14 year olds sexy, etc.). His wife says I just don't understand; he is just friendly and thinks everyone is his buddy, etc.
There are many little tenant laws he violates, but my concern here is fighting the eviction. We live in a small rural county and there are NO other rentals here, nor do I, a furloughed and thus unemployed single parent have the resources to move. It seems the eviction moratoriums in place during COVID are to protect those who cannot pay their rent, while I have made full timely payments thus far. Does this law protect me too? He has been dropping small comments here and there that he is going to rebuild the roof over our (single family dwelling on a setback lot/ mobile home) house and then sell it, thus the eviction. He is so used to enjoying his tall, older, well-to-do white male privilege that he fully expects me to accept his many violations of tenant law. I called the county courthouse and they said they are accepting filings for unlawful detainers but aren't issuing summons until the governer lifts his orders. My friends report he says that he hopes, "I just move out" and contracted another friend for cleaning services on my move out date.
I am supposed to move out 10/15/20, but I am not planning on moving until I can find an acceptable rental in the same neighborhood (my children's' dad lives down the block) and I am a local volunteer firefighter and search and rescue agent. He doesn't report his rental income, forcing me to pay in cash, so I doubt he will file an unlawful detainer, but will probably help himself to a self-help eviction since he has no problem harassing me already. He has this 'deal' where the rent is $1,000, but if I pay on time (which I have 100% of the time), then he gives me $100 rebate and a handshake. Which makes rent effectively $900/ monthly. Ugh. I looked up the Calif. law that says landlords have to offer an alternative to cash, and so I started mailing him rent checks for the $900 (writing 'For rent for my address and the month in the memo), mostly so I don't have to go next door and look at his face while he makes uncomfortable comments. He then decided that the previous 'rebate' is a cash-only thing, and insists I pay him the full $1000 now, even though there are no verbal/ written agreements that say this, AND charging me a check cashing fee of $9.50 because he cashes it at my bank rather than leave a paper trail by depositing it at his own bank. Literally, he is charging me a fee because he doesn't want to report his income. WTF.
The list goes on, i.e. forbidding my friend with an ADA service dog entry into my home for her dog (NOT an emotional support animal but actually a service dog) and sitting on my front porch to watch the handyman mow, emailing me how cute I look in my pajamas, leaving enormous penile shaped vegetables he grew on my porch, god, I'm sure I could think of another 8-10 things... Statistically in this country, it doesn't usually go well if you charge a guy like this with sexual harassment, so I want to keep it based on Calif. and Federal tenant law.
Any advice how to handle this guy? His entitlement is scary, and yet, I'm not going to get turned out of my home because he's mad. I'm going to write him a letter of notice tomorrow and attach it with my full month of rent check, rather then the two weeks prorated, lol. Thank you!
TDLR: I told landlord's wife he is being creepy to me and my kids, and I get evicted two days later, I suspect the move-out notice is invalid because A. he didn't specify he is exempt from the just-cause eviction law, and B. there is a COVID eviction moratorium in place. Advice?

2020.09.29 23:26 platanoparty How to find your makeup and hair stylist during covid era?

I am stuck - I was supposed to get married this July but obviously had to postpone to July 2021 (I’m in California). I never booked anybody but my top choice artist raised her prices and I cannot afford what she is asking.
For context, I am not having a bridal party and it’s only my mom and I having any styling services day of the wedding and one trial for myself.
Because I am not someone who regularly wears makeup in the first place, I’m more stuck on this vendor than any other. I am finding that the majority of artists are charging $2500+ for just the two of us (kind of disheartening - I believe in paying artists a fair wage but admittedly, this is way beyond what I expected for just my mom and me). I am located in the Bay Area which is an expensive place to be, but Im at a loss because I have to sign a contract and can’t get a trial any time soon because of covid in order to get my wedding date. So I’m worried I may sign someone without being confident in what the trial looks like and will have already paid a big chunk of money for something I’m not confident in.
My artist from my engagement shoot was my regular hair stylist who I can’t use anymore as he’s moved out of state to high cost of living and not being able to run his business anymore. I have asked my photographer and she’s shared some great people, only one was available. However, because she is Korean and has only worked with Korean brides, I’m a bit unsure if it would be a good fit (I am latina and have lots of curly hair and different face structure).
TLDR: how are you able to find and discern your make up artists in a tricky time? With a clock ticking on so many weddings next year (that we don’t even know will happen yet) I feel like I have to book someone soon without getting a trial or comfortable with them. Aside from looking at their portfolio, what are some specific tips and things to look out for (ie bad communication etc)?

2020.09.29 16:32 JBL_0 DEA / CIA and FBI operated in Mexico to hunt and trap "El Chapo," reveals NYT reporter's book

DEA / CIA and FBI operated in Mexico to hunt and trap
“'El Jefe' by Alan Feuer, available in Spanish only in audio, is not a book about narco-corruption in Mexico; nor an analysis of the failed war against the cartels, much less the history of drug trafficking. It is the journalistic work of a reporter specialized in criminal proceedings who, with privileged sources, incurs in the hidden world of cyber espionage that presided over the capture of Joaquín Guzmán Loera, ”says journalist Dolia Estevez in this special installment for the readers of SinEmbargo.
By Dolia Estévez Sinembargo September 29, 2020 12:05 am
Washington, DC, September 29 (Sinembargo) .– When the eyes and ears of the vast wiretapping apparatus of US agencies located Joaquín “El Chapo” Guzmán Loera in a remote migratory bird wetland in southern Baja California in 2013 What followed was not to inform the Government of Mexico about the finding, as appropriate, but to internally debate which of the Mexican agencies was the least corrupt in order to invite it to capture .
The Federal Police were the first to be ruled out due to the legacy of narco-corruption left by Genaro García Luna . The FBI and CIA favored the Army , as they usually do. But, just as the FBI and the CIA did not trust the Federal Police, the DEA did not trust the Army. The Marshals Service and other agencies proposed the sailors, for their reputation for bravery and skill. However, there was a problem. Capturing Guzmán Loera carried the risk of pitting the Secretary of the Navy against civilian leadership. Protection of the leader of the Sinaloa CartelHe came from the high hierarchy of the Government of Mexico. However, when the DEA offered them the delicate task of capturing him, the sailors accepted without hesitation.
Víctor Vázquez, chief of the DEA station in Mexico, accompanied the sailors to the naval base in La Paz from where they would launch the operation that they called “Duck Dynasty” (duck dynasty), because it was near a club of duck hunting. Vázquez's job was to eat, sleep, and travel with the sailors. He trained with the unit. He rappelled down from the Blackhawks helicopters with them, helped them analyze the signals from the drones that covered the area where they located El Chapo, and shared the accumulated erudition of the interception and hacking machines to build what he called a “capture intelligence manual. ”. For practical purposes, Vázquez, a Mexican American from Durango, was in charge of the security of the operation. Everything in national territory.
But as impressive as the intelligence of the Americans was, they could not with the methods of counter espionage and with Guzmán's network of government spies. The resources and equipment of "Chapo" rivaled those of the most sophisticated terrorist organizations in the world. A few days before the attack, planned for January 2014, wiretaps picked up signs that the cartel knew about "Duck Dynasty." The mission was aborted. "El Chapo" won the play. Once again.
The unpublished account comes from the new book "El Jefe The Stalking of Chapo Guzmán" (" The Boss, the stalking of Chapo Guzmán "), by Alan Feuer , correspondent for The New York Times who became known in Mexico for his timely coverage and real-time tweets about the famous drug lord's trial in New York. 235 pages long, edited by Flatiron Books, the text focuses on the marathon intelligence work to capture "Chapo" by a select group of secret agents from the FBI, the DEA, the CIA and the Marshals Service, known as the "coalition".

Forerunners of the effort were Stephen Marston and Robert Potash, FBI agents in New York. Ray Donovan, from the DEA's Special Operations Division, a secret unit in charge of wiretapping narcos, was the link with the agents in Mexico. Feuer details how they intercepted and hacked the communications of Guzmán's inner circle: lieutenants, bodyguards, wife and lovers. The team, which operated largely on the sidelines of Mexican authorities, was obsessed with apprehending him. If they didn't do it before, it was because of Mexican corruption.
Between 2009 and 2016, the "coalition" planned seven captures: Los Cabos, two in Tepic, a raid in Culiacán led by the CIA, "Duck Dynasty" in La Paz, the arrest at the Hotel Miramar in 2014 that ended in his escape from Altiplano in 2015 and the last one in Los Mochis in 2016. With the exception of two, the rest failed because they fled earlier or because the missions were aborted. The big obstacle, Feuer says, was corruption in the Mexican government.
“Finding Guzmán, as the DEA well knew, was always the easy part. Communications were so essential to their operation that there was always surveillance intelligence to pinpoint their whereabouts. The hardest part… due to the corruption in the government, was deciding who to trust with his arrest among the local police agencies, ”Feuer writes.
It was not until "Operation Third Strike", which led to his arrest in 2016, that CISEN finally got involved. “El Chapo” had fled the Altiplano again through a tunnel a year earlier, which not only humiliated Enrique Peña Nieto but also revealed his government's collusion with the cartels. Surprised that every lead they developed was already owned by the Mexicans, eventually the “coalition” realized that CISEN had a secret weapon: the powerful Israeli technology spy program, Pagasus. He did not skimp on using it to find "El Chapo."
Feuer's work affirms the broad scope for US agencies in Mexico. It leaves little doubt that the location and eventual arrest of "Chapo" was primarily the work of persistence by the United States. Although foreign policemen by law cannot make arrests and be armed in national territory, it is known that DEA agents invariably carry weapons when they accompany Mexicans in operations to arrest high-ranking whites. The Mexican government turns a blind eye.
As I wrote in this space, three consecutive presidents - Fox , Calderón, and Peña Nieto - gave orders for DEA, FBI, CIA and ICE agents to operate in Mexico with complete freedom ("DEA Academy, factory of double agents ”, 03/17/2020, SinEmbargo).

Feuer mentions the alleged narco payments to García Luna and Peña Nieto that protected witnesses brought up in the “El Chapo” trial. They are part of the criminal accusation against García Luna in court in New York. The version about Peña Nieto has not been corroborated.
What the New York reporter did corroborate was the drug's penetration into the Sensitive Investigations Unit (SIU) of the Federal Police, whose members were trained at the FBI academy in Quantico and passed the confidence tests that the DEA applied to them. Feuer says that, after the failed attempts to capture him in Los Cabos and Tepic, the DEA began to doubt the SIU, his counterpart in the Federal Police. The FBI assigned a senior official to investigate her in 2013. At the end of that year, the investigation confirmed the suspicions. "The SIU and the Federal Police could be described as the uniformed law enforcement arm of Guzmán's organization," Feuer writes.
The suspicions of the FBI were confirmed years later with the imprisonment of Iván Reyes Arzate, accused of spying for the Beltrán Leyva, at the same time as head of the SIU, and the arrest of García Luna, head of the SIU and founder of the Federal Police, for serious crimes related to drug trafficking. Feuer failed to include the recent accusations against Luis Cárdenas Palomino and Ramón Pequeno García, also high-ranking officials of the Federal Police and henchmen of the DEA. The author does not explain how the DEA did not find out that he was in bed with the enemy.
Feuer bases his account primarily on three sources: interviews for attribution with US officials who conducted the electronic espionage, the full transcript of the 12 weeks of the trial, and thousands of pages of investigative records on Guzmán and related cases, many of them unpublished. . The book lacks Mexican filers. She tried to talk to some of the protagonists in Mexico, but, she notes, almost all of them declined.
https://preview.redd.it/2nu52jkyk3q51.jpg?width=656&format=pjpg&auto=webp&s=e1e442d8475d567278943a80754f24b621d57e86
The book records the role of the CIA and NSA in the persecution of Guzmán. One of the failed operations in Culiacán, of which almost nothing is known, was led by the CIA. Both declined requests for information through the US Transparency Act. “The role of the CIA in the El Chapo case is buried in secret files… thousands - perhaps tens of thousands - of documents in scores of cases related to the capo and his collaborators remain under seal to this day. They contain the equivalent of the untold story of Mexico's drug war. "
“El Jefe” by Alan Feuer, available in Spanish only in audio, is not a book about drug-corruption in Mexico; nor an analysis of the failed war against the cartels, much less the history of drug trafficking. It is the journalistic work of a reporter specialized in criminal proceedings who, with privileged sources, incurs in the hidden world of cyber espionage that presided over the capture of Joaquín Guzmán Loera. The result is a compelling crime thriller- like tale based on real life.
*** The stalking of "Chapo" is a sample button of the historical interference of US espionage agencies in Mexico, from the "proconsul" Winston Scott to date. While, in the cold war, espionage was conducted from a secret room in the United States Embassy in Mexico, today it is carried out through an extensive technical menu that includes eavesdropping machines and decryption of encrypted communications, hacking of computer systems, real-time monitoring drones, spy planes in Mexican skies, and blank checks to jam phones of selected targets in Mexican territory, as long as they are authorized by a US judge ... because Mexico is a sovereign country.

I originally wanted to go navy but they dqed me full stop nothing they could do. I talked to my army recruiter and told him about my situation. He told me i should lie and not to worry about it. But i have scars on my arm from SH and the navy already has my full medical records. Should i be worried about the navy's records getting to the army? And should i go against my morals and lie to meps? Like i said i really have no other plans i didn't realize its was a automatic DQ even if you are better for multiple years.

Hey all, I hope you're doing well! I was just wondering if some of you could clarify what my recruiter told me. I first asked my recruiter about 2 year active duty contracts and also asked him if it would be 2 years active with 6 years of IRR or if it would be 2 years active with 2 years in the Reserves and then 4 years of IRR. He said it was possible to make it 2 years with 6 years of IRR (which seemed too good to be true), but I went along with it. I was supposed to go to MEPS in the next few days, but thankfully another recruiter caught the mistake and informed me it was 2 years active with 2 years in the Reserves. After that, my recruiter offered a 3 year contract. However, the other recruiter clarified it was 3 years plus basic and AIT. Is that true or does the 3 years include both BCT and AIT? Thanks for the help!

I'm very happy with myself, good mental stability and some other virtues so i'm not worried about ending up in a bad place.
I am worried i will end up with no one in my life. I have no family, some friends but they won't be around. Should i take this into consideration? Is this something i should be worried about?

So I got out of RA a year ago now. I served “7 1/2 years”. I went into the reserves right after went to 5 drill weekends never got paid never got a chance to inprocess. I did everything they asked , January rolls around I ask them to go IRR the CO and Top had no issues with that. I fill out the paper work then, I leave my PSG sends me a message saying they can ETS me instead like I never was in the reserves. I agreed to it and I drove on. Everything is good for a few months I finally get a message from my PSG I need to sign the paper work again, after not hearing from anyone over there for months I do it and not worry about it. I get told a month later, I gotta check in with my PSG once a week to check the status of my packet. which I do no problem fast forward to August. I’m getting told to sign my NCOER even though, I only worked for them about 5 months so I’m hesitant about signing. A new PL gets mad and tells me I have to if not I’ll get demoted and a negative discharge and says I have all these U’s for Feb-July I should basically have my ass handed to me. so I was forced to sign and start attending their zoom meetings. I spoke to my PSG and 1sgt about everything and they just tell me okay then brush it off, it’s like I’m not being heard. I spoke to jag they said the only thing they can do is fix the pay issue. So my question is what should I do? What can I do I just want to be done with them?

The application has you fill out a financial statement (cc form 228-r) and it's very invasive about your finances. Things like partner's salary, total monthly debts, whatever I'll fill it out. I'm confused though, in the bottom portion it asks about total monthly income, stipends, loans, salaries, ect.
So I guess the few things I'm not understnding are, don't I "ETS" and not have a salary unless I get a part time job? Do I stay "in" with the division commander's hip pocket scholarship and accrue federal service time? If I stay in, do I keep my current salary and get BAH and things like that? If I have to uproot my family and PCS to my college with no salary and living off of a $420 stipend, I don't think my wife and me could afford it which would definitely hamper my commissioning process.

My recruiter is telling me to lie about multiple things and I am uncomfortable doing so. I am 27 years old. I was on anti-depressants about 6-7 years ago for a short period, but stopped taking them quickly after starting. I DID have a prescription though and he's saying to just say I didn't. I am not depressed and have not had any issues since, but I don't want to lie and screw myself later on.
I did convince him to include a waiver for a misdemeanor charge from about 5 years ago. It irritated me that he even suggested just ignoring it.
I'm also getting a waiver for a surgery I had about 14 years ago (foot injury called "jones break", simple surgery)
Then there's just weird shit he's saying to lie about, like saying my wife's step-dad is her real dad. Saying I never had a passport, even though I did and just no longer physically have it.
Everyone in this recruiting office seems to say the same things he does.
I want this badly. I want to serve my country. The thought of doing it by beginning with a lie makes me feel ashamed of myself. I have not yet been to MEPS. Only done some paperwork and taken a pre-ASVAB test (scored 75). Should I just contact a different recruiter and explain my situation? I don't want to just screw over my current recruiter, but I really don't want to fuck myself down the road for stupid lies.

Just a few questions if anyone is willing to help out. I’m currently serving in Active Duty right now. Just hit my two year mark. Hitting my ETS date in 18 months. I’m probably going to separate from the Army once I hit my time but I was also thinking about switching to the National Guard. My questions are: For anyone who has done switched, how different was it from Active Duty? Another question is: Is it possible to be a part of a State’s Unit without actually having lived there? Basically, I’m originally from California, but I’d want to move to Arizona, so is there a way I can be a part of the AZ National Guard, or would I have to be a part of the CA NG? I understand that I would need to be a current resident for the particular state to be a part of its NG, but what if it’s a switch from Active Duty?

I dont wanna be stuck at a desk all the time, but I don't need to be in the field all the time either... Tl;DR: Do you need to go active to get good training or is OSUT enough?
Hello, I have a few questions about joining the army infantry to determine if it's even a worthwhile pursuit in this day and age.
Is Infantry OSUT even useful training? Or do you only get the useful stuff at your unit? Could you be somewhat competent with just this and possibly being trained by a combat veteran?
Does your active unit even teach you good training nowadays, or would I be spending my entire 2-3 year enlistment as basically a glorified janitogroundskeeper now that it's peacetime?
If the active route doesn't hold much value anymore, would I basically be getting the same value in terms of training and skills to just join the guard or reserves?
Thanks for anyone taking the time to read this and respond.
I'm a prior service Air Force vet and a former amateur MMA fighter. After learning to fight with unarmed for 2 plus years, I've come to realize my complete lack of skills in regards to weapons and modern combat (and TBH, I also kind of miss the military life). With the way the world is going, I think these skills are becoming increasingly important. I don't expect or want to become some kind of door-kicking badass operator, but I would like to have gun skills and be able to be somewhat competent in a firefight.

Would that exempt me from all vaccines?

And some that won't be friends after i join (i don't follow the lifestyle i was raised in and this is another thing that goes against some cultural expectations etc,was cut out of the community/family/friends) long story short,Can i count on the army to provide some opportunities for a social life/friendship or can i end up like some of these posts? Super new to researching entering into the military. Someone I know in a different branch told me that when you join Army, no matter your MOS (even if you get 92Y or 68X) you will indefinitely ship to fight. Is this accurate?
Also how often can you change your MOS?

How's Benning at the moment? I hear it's a bit crowded. I was wondering what that leaves in store for prior service coming there for OSUT

I'm 28 almost 29 years old, have my bachelor's degree, but I'm not in-shape. I'm currently looking at enlisting as an E-4 and hoping to later go to OCS and commission as an officer. What would be a realistic timeline (my recruiter says I could basically arrive at the unit and request ocs right away...sounds fishy to me) and which MOS would be good for this (if any are better than others)?

Sorry for sounding so naive, but quite frankly I'm someone that knows jk st about the military (I have an idea about it, but that's as far as it goes). I'm intent on enlisting, and still weighing the pros and cons between these two branches.. I feel interested in both, but can't make up my mind. I dont wanna be stuck at a desk all the time, but I don't need to be in the field all the time either... I do plan on becoming an officer once I get my bachelor's but I heard it gets pretty competitive in the AF when compared to the Army... what input do you guys have for a guy like myself?

2020.09.28 06:08 sugarpea1234 Force majeure advice?

X-Posted with Legal Advice!
In late January of this year, I signed a contract with a wedding venue in Northern California. We also got wedding insurance on 2/14/2020.
Our 200-person wedding was going to cost roughly $75,000 for the venue and food paid over the course of four payments. The wedding contract does NOT say the number of attendees at the wedding. Rather, it commits us to spending a minimum of $51,000, plus taxes and service charge of 25%. We do have emails reflecting that the understanding was that we'd have 200 people at the wedding.
Of course, a month later, the WHO declared COVID-19 a pandemic and the venue's city went into shelter-in-place shortly after. We contacted the venue and they agreed to postpone the wedding until 4/17/2021 at no charge. We agreed to a new payment schedule of paying the second payment on 7/1/2020, third on 12/1/2020, and the final on 4/1/2021. Now we are realizing that there is no way we can have the wedding at all on 4/17/21; and it's likely that Northern California will continue to only allow gatherings of no more than 10 people at that time. It's unlikely that we'd be able to have 220-people wedding on that date (nor would we want to until there's a vaccine disseminated widely). Now I am trying to figure out my options:
  1. Do we attempt to go through wedding insurance? And if so, at what date and do I continue to make payments to the venue? Really don't like this option.
  2. Do we cancel the wedding now before paying the third payment of roughly $19,000? If we cancel anytime before 1/17/2021, we owe 50% of the minimum beverage amount of $51,000 plus taxes and service charge, for a total of $37,523. We've already paid them roughly that amount in two payments (one at signing and one on 7/1/2020).
  3. Do we attempt to negotiate with them to try to get some or all of our money back? There's a force majeure provision in our contract, which states that no damages will be due for failure for performances for due to acts of God, war, government regulation, riots, disaster or strikes, any of which make performance impossible. Given that the shelter-in-place is likely to continue through 4/2021 (we are in Northern California), it's unilkely that they'd be able to hold a 200-person wedding on our wedding date. The contract does NOT state the number of people we'd have at the wedding, just the minimum beverage but we have emails with the venue stating that that was the understanding.
For what's worth, at the time we agreed to a new date, I received in writing the following confirmation from the wedding venue: "As discussed if there is a force majeure by them [NOTE: I think she meant by "then"] or any rules from the government that don’t allow us to have the wedding has planned on the contract we will either process to a refund or review the food and beverage minimum." I'm really at a loss as to what to do and whether I should hire a lawyer to help. Thanks for reading this! I appreciate any help/insight. And before you state it, I KNOW we're ridiculous and stupid for spending this much on a wedding.

2020.09.27 05:04 strokenblue Right Wing Terrorism kills the only two on duty cops in any protest...

2020 boogaloo killings
In late May and early June 2020, two ambush-style attacks occurred against security personnel and law enforcement officers in California. The attacks left two dead and injured three others.
Part of domestic terrorism in the United States and the 2020 United States racial unrest
Location: Oakland, California, U.S., Ben Lomond, U.S.
Date: Oakland shooting: May 29, 2020
Santa Cruz County shootout: June 6, 2020 (PDT)
Attack type: Shooting, bombing, shootout
Weapons: Rifle, improvised explosive devices
Deaths: 2
Injured: 4 (including one of the suspects)

Motive: Right-wing extremism

Accused: Steven Carrillo, Robert Justus
The attacks began on May 29, when a drive-by shooting occurred in front of a federal courthouse in Oakland, resulting in the death of a security officer contracted with the Federal Protective Service. Over a week later on June 6, Santa Cruz County sheriff's deputies were shot at and also attacked with improvised explosive devices; one of them died as a result.
U.S. Air Force sergeant Steven Carrillo was arrested soon after the second attack. A second suspect, Robert Justus, surrendered to authorities five days later. The FBI indicated that Carrillo was associated with the boogaloo movement, a loosely organized American far-right extremist movement whose participants say they are preparing for a second civil war.[1][2][3] Carrillo used the George Floyd protests as a cover to attack police officers, according to the FBI.[4] A white van owned by Carrillo contained a ballistic vest with a patch bearing boogaloo symbolism. Carrillo is alleged to have written "boog" and the phrase "I became unreasonable" (a popular meme among boogaloo groups) in his own blood on the hood of a vehicle he hijacked.[5] According to federal authorities, the suspects were motivated by the boogaloo movement's ideology, and allegedly intended to spread its extremist views and start a race war.[6][7]
Attacks
Oakland, California shooting
At around 9:44 pm on May 29, 2020, an initially unknown assailant (later identified as Carrillo) fired a rifle out of the sliding door of a white van, striking security personnel stationed outside the Ronald V. Dellums Federal Building in Oakland, California.[8][9][10][11] Two Triple Canopy security officers contracted with the Federal Protective Service were shot, resulting in the death of David Patrick Underwood and the serious injury of the other.[12] The attack occurred during the George Floyd protests in California.[13][9] Video surveillance later revealed that the van did not have license plates and had been in the area for at least half an hour. A man was seen exiting the driver's seat and walking around for 10 minutes before the attack.[14]
Santa Cruz County, California attack
On June 6, 2020, Santa Cruz County Sheriff's Department deputies arrived at Carrillo's residence in Ben Lomond, California. In response, Carrillo allegedly fired at the deputies with an AR-15 style rifle, seriously injuring one deputy and killing Sheriff Sgt. Damon Gutzwiller.[14][15] Two nearby California Highway Patrol officers responded to the scene, and were met with gunfire, wounding one officer. Deputies and officers were also attacked with improvised explosive devices.
During the shootout, Carrillo was hit and fled on foot to a nearby highway where he hijacked a car.[15] He abandoned the car minutes later.[16] According to the criminal complaint against him, Carrillo scrawled messages in his own blood on the hijacked car that said "I became unreasonable", "stop the duopoly", and "Boog".[15]
Carrillo tried to take another car from where it was parked at a home, but was restrained by the homeowner and another civilian.[16] Carrillo was arrested in connection with the attack.[17][18]

2020.09.26 19:00 Sweet_Tangerine50 Employer laid me off, giving employees severance and a “COBRA subsidy payment.”

I live in California and I think I’m just going to go through the CoveredCA process instead of COBRA. However, the document they gave us to send in in exchange for severance also includes a “COBRA Subsidy Payment.” Does this mean I HAVE to go through COBRA? The document states:
I understand that, in connection with my separation from (company) I have been offered Severance Pay and a COBRA Subsidy Payment in exchange for signing this Agreement. Provided that I timely execute this Agreement, the Severance Pay and COBRA Subsidy Payment will be payable pursuant to the terms set forth on Attachment A and will be paid fifteen (15) days after the later of (i) my execution of this Agreement.
Another area reads:
A lump sum severance payment will be made to you fifteen (15) business days after the later of (i) your execution of the Agreement or (ii) your Last Day of Employment (defined in Attachment A of your Agreement) Please note that the COBRA reimbursement (if applicable) will also be included in this lump sum amount. The COBRA payment is the difference between your current employee contribution and the total COBRA payment.
Also:
If you are enrolled in a group medical insurance plan offered by (company) as of the Last Date of Service, then (company) will provide you with an additional lump sum payment intended to temporarily subsidize your cost of maintaining such medical insurance coverage (“COBRA Subsidy Payment”) for the period of weeks specified above following the Last Date of Service (“Subsidy Period”). This COBRA Subsidy Payment shall be equal to the difference between what you are now required to pay for monthly COBRA medical insurance premiums during the Subsidy Period and the amount you would have normally paid during the Subsidy Period if you had remained actively employed. The Subsidy Period shall, in no event, exceed a maximum of 12 weeks and will be paid in a lump sum to be included with the Severance Pay Amount. At the end of the Subsidy Period, you will be responsible for paying for premiums in accordance with the applicable COBRA rates. You are solely responsible for maintaining other insurance coverage (dental, etc.) on and after the Last Date of Service.
I’ve read through the agreement and nowhere does it say “Using this subsidy payment for anything other than COBRA will result in...” or anything like that. It just sounds like they’re including their healthcare contribution amount in my severance, since it’s all being included in one check.
Just looking for some input, thanks.

2020.09.26 08:09 AdequateSizeAttache Setting the Record Straight on the Evidence of Prior Sexual Abuse - Part 1

[This post has been split into two parts because of selfpost character limits.]

Introduction

It surprises me how often I see discussions involving speculation on whether JonBenet's UTIs, vaginitis, bedwetting, and history of frequent doctor visits indicate sexual abuse or not. These discussions invariably include people chiming in to share how they or someone they know had similar issues but were never abused. From these discussions, one could get the impression that itchy pageant costumes or Mr. Bubble useage are perfectly reasonable explanations for the evidence of sexual abuse.
The fact is, there's no need to speculate based on these things. There is physical evidence of prior sexual abuse. This is the evidence that should be at the forefront of discussions on the question of sexual abuse, not bubble baths or bedwetting. Issues such as vaginitis, UTIs, and bedwetting are not specific to sexual abuse; there are other possible explanations for them. There is no other possible explanation for the physical evidence besides trauma from physical penetration.
In reading discussions on the case over the years, it's always puzzled me how often the evidence of prior sexual abuse gets downplayed or dismissed. In considering why, I believe it is due primarily to these two common misconceptions:
Common Misconception 1 (as demonstrated above): The evidence of sexual abuse = vaginal irritation, UTIs, rashes, bedwetting, soiling, frequent doctor visits
Common Misconception 2: There is a medical debate on the issue and there's evidence to support both sides
Common Misconception 1 is a straw man argument — the actual evidence (the physical findings) is not being addressed or refuted.
Common Misconception 2 is an argument from false equivalence. An equal, rather than accurate, amount of weight is given to both sides of the issue. People see the mountain of conflicting information and contradicting opinions and think "It looks like expert opinion on this issue is divided; I guess a case can be made for either side." The enormous difference in expertise and experience between the various experts is ignored, as is the level of access they had to the evidence. This misconception gives the impression that all these expert opinions cancel each other out, rendering the issue debatable and open to interpretation. Consequently, the probative value of the evidence is undermined, making it easier for people to feel they can dismiss.
I think several factors have contributed to these two misconceptions:
However, if one takes a closer look at the evidence, it becomes apparent that it is not weighted equally on both sides. There is no medical debate, but a medical consensus. Every child sexual abuse expert who examined the genital findings from JonBenet's autopsy recognized physical signs of sexual abuse that predated her murder. Despite some objections to their conclusion, no one has disputed the physical findings of these experts. Their findings are compelling and should be seriously considered. In order to do that, though, one must first understand what the findings are and get acquainted with the doctors who testified to them.
The purpose of this post is to lay out everything that is known about the evidence of prior sexual abuse, but also to put it into a larger context so that hopefully it will be better understood. This will involve delving a bit into the history of child sexual abuse evaluations (it will become relevant later), as well as some background information of the experts involved. I will also go over dissenting opinions and address some common counterarguments and myths.

The evolution of modern pediatric sexual abuse evaluations: A brief historical timeline

1857 - One of the first known forensic medical studies on child sexual abuse, Étude médico-légale sur les attentats aux mœurs (Forensic study on offenses against morals) by French medical doctor and pathologist Auguste Ambroise Tardieu, is published. This treatise describes various forms of child abuse and maltreatment and includes anatomical drawings of genital findings which by modern standards are considered surprisingly accurate and ahead of its time. For some reason these efforts are largely ignored and it will be over a century before interest in sexual abuse evaluations from a medical perspective is resurrected.
1940s-50s - Child sexual abuse remains an unacknowledged taboo. Medical textbooks of this era tell doctors that children can contract STIs like gonorrhea from non-sexual means, such as from toilet seats, sharing towels, or sleeping in the same bed as an infected adult. Such myths will pervade for decades.
1962 - "The Battered Child Syndrome" by pediatrician C. Henry Kempe is published and physical child abuse is recognized. A watershed moment in pediatrics and child abuse protection. This article is about detecting hidden signs of physical abuse using modern radiological technology and newly proposed evaluation guidelines. Detecting chronic or hidden sexual abuse, however, will prove to be a more enduring challenge.
Late 1960s - By now all 50 states have child abuse protection laws in place.
1970s - Feminist campaigners and policymakers take up the cause of child sexual abuse. Most child protection workers during this period are social workers and therapists. The field of child abuse protection and evaluation is in its nascency.
1974 - Congress enacts the Federal Child Abuse Prevention and Treatment Act (CAPTA, P.L. 93-247). CAPTA creates a nationwide focus on establishing standardized protocols for dealing with all forms of child abuse and neglect. Mandatory reporting is one component of CAPTA. Before, only doctors were required to report cases of suspected child abuse; now, it is anyone in a position of authority — teachers, camp counselors, etc. Consequently, there is a significant increase in the reporting of child abuse cases and an increase in the demand of evaluations for suspected sexual abuse. Most of the physicians doing these medical evaluations are not researchers or academics but work with prosecutor's offices and law enforcement.
1975 - Suzanne M. Sgroi, physician pioneer in the field, publishes an article calling child sexual abuse "the last frontier in child abuse" which "remains a taboo topic in many areas."
1977 - C. Henry Kempe brings awareness to the issue of child sexual abuse by following up "The Battered Child Syndrome" with a landmark lecture at the Annual Meeting of the American Academy of Pediatrics in New York City. The talk, titled "Sexual Abuse, Another Hidden Pediatric Problem" is published in the journal Pediatrics the following year.
1980s - Doctors start examining children's genitals, documenting, cataloging and trying to interpret their findings. Some use a colposcope, a binocular-like instrument originally used to detect cervical cancer, which magnifies the vaginal canal and tissues up to 4-30x. Some take anatomical measurements which they use to develop criteria for suspected abuse. They know what findings they see in abused children, but there is an acute lack of understanding of what "normal" or nonabused genital findings look like.
1981 - The article "Sexual Misuse: Rape, Molestation, and Incest" by Dr. Bruce Woodling is published in the journal Pediatric Clinics of North America.
Dr. Woodling is a California physician whose area of specialty is in sexual abuse forensics. The paper presents his research on what he has dubbed the "wink response test", a concept borrowed from Tardieu's 19th-century forensic manual. This test involves stroking the area near the anus with a cotton swab and gauging the response — contraction of the sphincter indicates no abuse, while an involuntary opening or 'winking' response indicates prior penetration. It was a test Tardieu developed to diagnose pederasty and Woodling has applied it to children as a way to detect anal abuse.
1982 - The wave of daycare sexual abuse hysteria of the 80s begins with the Kern County abuse allegations. The investigation and trial will culminate in the conviction of two couples (the McCuans and Kniffens) for sexually abusing several children. Dr. Woodling's wink response test and testimony play a part in their conviction. Several other similar cases in the same area at the time result in convictions of several others.
1984 - Daycare abuse hysteria continues with the Fells Acres and McMartin Preschool accusations. In the Fells Acre case, day care teacher Gerald Amirault will be put on trial and convicted of sexually assaulting and raping nine children. Questionable interview methods of the children and unproven genital evaluation criteria form the basis for the conviction.
The McMartin preschool case is the first to receive major media attention in the United States. Pediatrician Astrid Heger, under the tutelage of Dr. Bruce Woodling, conducts many of the evaluations of the McMartin children and diagnoses the majority of them as having been sexually abused. The criteria used for the evaluations are based primarily on Woodling's research as well as other published papers at the time (e.g., Cantwell's 1983 study on hymenal diameter measurements). Many of the children are found to have suspect genital findings such as notches, clefts, bands, tissue tags, ruffled or rolled hymenal edges, 'microtraumas' seen only with magnification, hymenal openings which measure over four millimeters, as well as positive reactions to Woodling's wink response test.
mid to late 80s - More abuse allegations and convictions including Country Walk, Wee Nursery, Bronx Five, Little Rascals day care, Glendale Montessori cases.
1988 - Dr. John McCann, a pediatrics professor and researcher from UCSF School of Medicine, drops a bombshell at the 18th annual child abuse convention in San Diego. He presents the results of a study he and his colleagues have worked on the past four years. They had gathered a control group of about 300 nonabused/"normal" children and meticulously documented and photographed their anuses and genitals, the first such study to do so. What they learned shocked McCann and everyone else in the field. Many of the anatomic findings which some specialists were claiming to be signs of abuse were commonly found in the nonabused children. The study showed that the large variation of anatomical features of childrens' genitals were, in fact, just that — variations of normal. This meant that parents and caretakers were being reported and convicted based on erroneous unscientific criteria. This presentation, titled "Anatomical Standardization of Normal Prepubertal Children," is a watershed moment in the field.
1989 - The first paper based on McCann's study ("Perianal findings in prepubertal children selected for nonabuse: a descriptive study") is published in the journal Child Abuse & Neglect. Among its conclusions, it shows that Dr. Woodling's wink response test has no scientific basis.
The impact of McCann's study influences leaders in the field to call for an overhaul in the way sexual abuse evaluation criteria are approached:
Medical Examination for Sexual Abuse: Have We Been Misled?
The more we learn, the less we know "with reasonable medical certainty"?
1990s - This decade sees an explosion of research and progress. The second paper based on McCanns' landmark study ("Genital findings in prepubertal girls selected for nonabuse: a descriptive study") is published in the journal Pediatrics in 1990. The dropping of charges in the McMartin preschool trial, also in 1990, marks the beginning of the winding down of the nation's abuse hysteria. McCann's research is presented as evidence by the defense in some abuse trials, such as the McMartin and Little Rascals daycare cases.
1992 - A classification system for evaluating children for suspected sexual abuse is proposed by Dr. Joyce Adams, Katherine Harper and Sandra Knudson. This later becomes known as the Adams classification system (keep this system in mind as we will be referring back to it) and will be periodically revised with updated criteria throughout the following decades. It will be adopted and used in the field of child abuse pediatrics and gynecology worldwide. John McCann's research help form a basis for this system.
mid to late 90s - More research based on cross-sectional, case-control, and longitudinal studies of abused and nonabused children are published which improves understanding and accuracy of evaluation criteria: Berenson, Heger, Adams, Emans, Kellogg, Kerns, McCann, Muram, Finkel, etc. Due to the errors of the previous decade, specialists in the field are highly conscientious and prudent about differentiating nonabuse from abuse criteria.

The evidence of prior sexual abuse in the JonBenet Ramsey case: What we know

When Boulder County Coroner Dr. John Meyer performed JonBenet's autopsy, he identified signs of acute vaginal trauma which he believed was consistent with digital penetration. What we didn't find out until the publication of James Kolar's book Foreign Faction in 2012 is that Dr. Meyer also saw indications of prior sexual contact. Concerned about this possibility, he sought a specialist opinion and brought Dr. Andrew Sirotnak to the morgue to examine JonBenet's genital injuries. Dr. Sirotnak was a child abuse pediatrician who headed the Child Protection Team at Children's Hospital Colorado. He confirmed Meyer's opinion that there were signs of prior sexual contact.
Here are the relevant passages from Kolar's book:
  • Dr. Meyer also observed signs of chronic inflammation around the vaginal orifice and believed that these injuries had been inflicted in the days or weeks before the acute injury that was responsible for causing the bleeding at the time of her death. This irritation appeared consistent with prior sexual contact.
[Foreign Faction: Who Really Kidnapped JonBenet?, A. James Kolar, p. 58]
  • Following the meeting, Dr. Meyer returned to the morgue with Dr. Andy Sirontak, Chief of Denver Children's Hospital Child Protection Team, so that a second opinion could be rendered on the injuries observed to the vaginal area of JonBenet. He would observe the same injuries that Dr. Meyer had noted during the autopsy protocol and concurred that a foreign object had been inserted into the opening of JonBenet's vaginal orifice and was responsible for the acute injury witnessed at the 7:00 o'clock position. Further inspection revealed that the hymen was shriveled and retracted, a sign that JonBenet had been subjected to some type of sexual contact prior to the date of her death. Dr. Sirontak could not provide an opinion as to how old those injuries were or how many times JonBenet may have been assaulted and would defer to the expert opinions of other medical examiners.
    [Kolar, p. 61]
  • Dr. Meyer was concerned about JonBenet's vaginal injuries, and he, along with Boulder investigators, sought the opinions of a variety of other physicians in the days following her autopsy. Dr. Sirontak, a pediatrician with Denver Children's Hospital, had recognized signs of prior sexual trauma but neither he nor Dr. Meyer were able to say with any degree of certainty what period of time may have been involved in the abuse.
    [Kolar, p. 63]
Boulder Police would later ask several child sexual abuse experts to review the autopsy findings* in order to help them determine if there was evidence of prior sexual abuse. In addition to Andrew Sirotnak, these are the experts whom we know were consulted:
Richard Krugman
James Monteleone
Valerie Rao
John McCann
That's right — that John McCann. The same John McCann who was responsible for putting child sexual abuse evaluations onto scientific footing and who happened to establish the standards for what is considered normal and abnormal in pediatric genital exams was consulted on the JonBenet Ramsey case.
In Steve Thomas's 2001 deposition for the Wolf v Ramsey civil trial, Thomas says that McCann came recommended by the FBI. There's a reason for that, which is that McCann was regarded as one of the the foremost authorities on interpreting pediatric anogenital findings in cases of suspected abuse. Thomas also refers to McCann, Monteleone, and Rao as the "blue ribbon pediatric panel." Based on various sources, we know that there was at least one meeting in Boulder in September 1997 involving McCann, Rao, Monteleone, and Krugman.
Here is the relevant passage from Thomas's book:
In mid-September, a panel of pediatric experts from around the country reached one of the major conclusions of the investigation - that JonBenet had suffered vaginal trauma prior to the day she was killed.
There were no dissenting opinions among them on the issue, and they firmly rejected any possibility that the trauma to the hymen and chronic vaginal inflammation were caused by urination issues or masturbation. We gathered affidavits stating in clear language that there were injuries "consistent with prior trauma and sexual abuse"...."There was chronic abuse"..."Past violation of the vagina"...."Evidence of both acute injury and chronic sexual abuse." In other words, the doctors were saying it had happened before.
...
The results, however, were not what is known in the legal world as "conclusive" - which means that there can be no other interpretation - and I would fully expect defense lawyers to argue something different. Nevertheless, our highly qualified doctors had brought in a remarkable finding.
[JonBenet: Inside the Ramsey Murder Investigation, Steve Thomas & Don Davis, p. 253]
The experts expected to testify in court had the case gone to trial. As we know, there was no criminal trial, but we know the experts were called to testify before the grand jury.
*During JonBenet's autopsy, an instrument called a colposcope was used to examine and document her genital injuries. This is standard procedure in forensic pathology in cases of suspected child abuse or sexual assault. Colposcopy illuminates and magnifies the vaginal cavity and is used to identify abnormal changes to tissue and the internal genital structures. The experts would have relied on these colposcopic photos as well as histologic samples of JonBenet's vaginal mucosa in addition to the autopsy report, coroner's notes, and lab results.

The physical findings explained

These are the genital findings we know were discovered at JonBenet's autopsy:
Ref. no. Finding Source
1 Chronic inflammation around vaginal orifice FF
2 Small amount of dried blood on perineum AR
3 Small amount of dried and semifluid blood on skin of fourchette and in vestibule AR
4 Hyperemia of vestibule and vaginal wall AR
5 Abrasion on hymenal orifice at 7 o'clock position, involving the hymen and vaginal wall AR
6 Epithelial erosion with underlying capillary congestion of tissue from 7'oclock AR
7 Hymenal orifice measuring 1cm x 1cm AR
8 A lack of hymenal tissue between the 10 and 2 o'clock positions AR
9 Vascular congestion and focal interstitial chronic inflammation of vaginal mucosa AR
10 Bruise on hymen BP
11 Three dimensional thickening from inside to outside of inferior hymenal rim BP
12 Narrowing of inferior hymenal rim to base of hymen BP
13 Exposure of vaginal rugae BP
AR = Autopsy Report
BP = Bonita Papers
FF = Foreign Faction
What do these physical findings mean?
Here is a quick break down:
  • 5, 6, and 10, with corresponding bleeding 2 and 3, are signs of acute trauma from the time of the murder.
  • 7 is something that gets brought up as evidence of prior abuse ("enlarged hymenal opening"). However, criteria based on hymenal opening measurements were removed from the Adams classification guidelines in 1996. McCann did not include it in his criteria for abuse, but said it supported the findings for abuse. Since the late 90s/early 2000s, specialists have tried to move away from using measurement-based criteria as it is difficult to do precisely. Research data has shown that measurements can vary with the examination position, technique, age of the child, state of relaxation of the child, and the skill of the examiner.
  • 8 describes a crescentic hymen, a common variation of hymen types. This is a normal finding. Generally, discrepancies of the anterior half of the hymen (above the 3 and 9 o'clock positions) are not considered concerning and missing segments, notches, clefts can be normal findings. It is the inferior half of the hymen (below the 3 and 9 o'clock positions) where experts look for indicators of abuse.
  • 11-13 are findings observed by John McCann that describe structural changes of the hymen from a prior penetration. 12 describes a transection (a healed laceration) of the inferior portion of the hymen.
  • 1, 4, 9 can be caused by a variety of other conditions and on their own are not classified as indicators for abuse. In the case where findings indicating abuse are also present, they need to be considered in context.
McCann's findings
The most important of these findings to understand is 12, which is one of McCann's observations outlined in the Bonita Papers.
There was a three dimensional thickening from inside to outside on the inferior hymeneal rim with a bruise apparent on the external surface of the hymen and a narrowing of the hymeneal rim from the edge of the hymen to where it attaches to the muscular portion of the vaginal openings. At the narrowing area, there appeared to be very little if any hymen present.
To understand what this means, take a look at the white line segment labeled "Hymenal width" in this colposcopic photo (warning: image of vagina/hymen). It demarcates the length of the hymenal membrane from the rim/edge to the base where it attaches to the vaginal wall.
A narrowing of the hymenal rim means the hymenal membrane is reduced in dimension from the rim/edge toward the base. When the rim is narrowed all the way to the base, that is called a complete cleft or a transection. A transection is a discontinuity of the inferior hymenal rim that extends to or through the base of the hymen. Basically, it is a telltale residual absence of tissue from a healed complete laceration.
If this is difficult to visualize, here is a figure which shows what transections look like:
Figure 3: Hymenal Membrane Characteristics
[source]
The Adams classification system
In the fields of child abuse pediatrics and pediatric gynecology, the set of guidelines most widely used in interpreting genital findings is the Adams classification system.
If we were to look at the most recently revised version (2018), we would see that it identifies certain "findings caused by trauma":
These findings are highly suggestive of abuse, even in the absence of a disclosure from the child, unless the child and/or caretaker provides a timely and plausible description of accidental anogenital straddle, crush or impalement injury, or past surgical interventions that are confirmed from review of medical records.
Among those findings that are "highly suggestive of abuse" includes point 37, listed in the subsection titled "Residual (healing) injuries to genital/anal tissues" under section E:
Healed hymenal transection/complete hymen cleft, a defect in the hymen below the 3-9 o'clock location that extends to or through the base of the hymen, with no hymenal tissue discernible at that location
This is precisely what Dr. McCann described having observed in JonBenet.
A transection in the inferior half of the hymen of a prepubertal child is a significant finding because it is considered a clear indication of a prior penetrating injury:
  • Multiple studies have noted the presence of hymenal transections only in prepubertal girls with a history of disclosed sexual abuse.
[ Sara T. Stewart, MD. Hymenal Characteristics in Girls with and without a History of Sexual Abuse, p. 533]
  • Hymenal transections are very rarely seen in prepubertal girls who have not been sexually abused. However, a demonstrated transection, based on multiple studies, is commonly viewed as “a clear but uncommon indicator of past trauma.”
[Mishori, R., Ferdowsian, H., Naimer, K. et al. The little tissue that couldn’t – dispelling myths about the Hymen’s role in determining sexual history and assault.]
  • Thus a deep notch, transection, or perforation on the inferior portion of the hymen may be considered as a definitive sign of sexual abuse or other trauma.
[Berenson, et al. A case-control study of anatomic changes resulting from sexual abuse, p. 829]
  • A transection of the posterior hymen between 4 and 8 o’clock in prepubertal girls suggests genital penetrating trauma; however, the presence of this finding is not confirmatory of sexual abuse. Posterior hymenal findings including transections between 4 and 8 o’clock, deep notches, and perforations were not seen in studies of prepubertal girls without a history of genital trauma from sexual abuse included in this systematic review. Therefore, one can conclude that the posterior hymenal findings of transections, deep notches, and perforations are extremely infrequent findings among children without a history of genital trauma from sexual abuse or other means. [...]
However, because the prevalence of posterior hymenal findings (between 4 and 8 o’clock) such as transections, deep notches, and perforations are near zero in nonabused prepubertal girls, the presence of these examination findings suggests genital trauma from sexual abuse. In the absence of known genital trauma from accidental means, the possibility for sexual abuse must be strongly considered. In a prepubertal girl with a posterior hymenal finding of a transection (between 4 and 8 o’clock), a deep notch (between 4 and 8 o’clock), or a perforation, a report to child protective services should be strongly considered. At a minimum, an examination by a child abuse specialist should occur to confirm these findings and to help provide a careful interpretation regarding the likelihood of sexual abuse.
[Molly Curtin Berkoff, MD, MPH; Adam J. Zolotor, MD, MPH; Kathi L. Makoroff, MD; et al. Has This Prepubertal Girl Been Sexually Abused?, p. 2790]
If any doctor or medical provider today observed a transection on the inferior half of the hymen of a prepubertal female patient, he/she would be required to make a report for suspected sexual abuse and an explanation would be required for how that healed injury got there. In forty years of research, this finding has not been seen in any other instance besides from penetrating trauma. In prepubertal girls, it is indicative of sexual abuse unless it can be shown otherwise.

What the evidence says

The evidence says JonBenet had been subjected to at least one penetration of the vagina through the hymenal membrane prior to her murder. The penetration caused a complete laceration of the inferior hymenal membrane. After the laceration healed, a transection and other structural changes of the hymen remained.
The age of the prior injury could not be determined, but based on his research on the healing of hymenal lacerations of prepubertal girls, it was McCann's opinion that it was more than ten days old. His research has shown that "most signs of an acute [hymenal laceration] injury were gone within 7 to 10 days." Some of the experts thought the prior injury could have been weeks or months old.
While the evidence could conclusively prove only one prior penetration, the experts believed there had been more than one instance of penetration/sexual contact and that JonBenet's genital findings indicated abuse that had been repeated or ongoing. They were unable to determine how many incidents over what period of time.
Four of the five experts (Sirotnak, Monteleone, Rao, McCann) were confident in their opinion that JonBenet's genital findings were diagnostic of sexual abuse. One (Krugman) could not disagree with that assessment, but lacking certain forensic evidence (i.e., the victim's testimony, the confirmed presence of sperm, or an STI), was unwilling to assume a sexual motive for the abuse. He felt there was evidence only of physical abuse of the genitals.

What else could explain the prior penetration/ hymenal trauma besides sexual abuse?

There are three known causes of transections in the inferior hymenal rim in prepubertal girls — penetrative sexual abuse, accidental penetrating trauma, and surgical intervention.
Most accidental genital injuries sustained by children are straddle-type injuries that involve a fall onto the horizontal bar of a bicycle, jungle gym, or picket fence. This type of accident involves compression of the soft tissues against the bony margins of the pelvic outlet. Trauma is usually limited to the external structures of the genital area (e.g., labia, clitoral hood, fourchette, perineum).
Accidental penetrating or impalement injuries that involve trauma to the hymen are relatively rare:
Of 161 accidental genital injuries reported in the literature, 3.7% involved the hymen.
[Child Abuse: Medical Diagnosis and Management, 4th ed. Antoinette Laskey and Andrew Sirotnak (eds.), p. 359]
However, they do occur and the resulting injuries can mimic those of sexual abuse. In such cases, it is important that the cause of the injury be confirmed.
Whether an acute or healed genital or anal injury is identified, it is incumbent on the medical professional to obtain a complete history of the nature of the injury. [...]
Key differences in the history of accidental trauma, such as a straddle injury, are that accidental injuries are more commonly observed by a third party, medical attention is sought immediately after the injury, a scene-of-injury visit confirms the plausibility of the injuries and the accompanying history, and the pattern of injury is consistent with the history.
[Child Abuse: Medical Diagnosis and Management, 4th ed. Antoinette Laskey and Andrew Sirotnak (eds.), p. 359]
If JonBenet's prior hymenal injury was the result of an accident or a past surgical procedure, it should be reflected in her medical records and easy to prove. An accidental penetrating injury that results in a complete laceration of the hymen is considered severe, one that would be painful and cause bleeding. It would be expected that most parents or caretakers would seek medical attention for their child's injury.
We know the Ramseys were not timid or frugal when it came to getting medical attention for JonBenet's injuries and ailments. We have records of her being seen by the doctor for various bumps, falls, and injuries, such as a bent fingernail from a fall, a bruised nose from faceplanting at a grocery store, a bump on the brow from a tripping fall, and a small cut to the cheek from a golf club swing. If JonBenet had sustained an accidental genital injury that resulted in a severe laceration, I find it very hard to believe she would not have been taken to the doctor for such an injury when she was taken for lesser injuries and ailments.
Clearly, there was nothing in her medical records that could account for such an injury or the Ramseys would have provided it to police.

2020.09.25 14:36 VisibleConfusion69 Open Letter to Steve Huffman and the Board of Directors of Reddit, Inc- If you believe in standing up to hate and supporting black lives, you need to act

Open Letter to Steve Huffman and the Board of Directors of Reddit, Inc – If you believe in standing up to hate and supporting black lives, you need to act
Dear Steve,
On June 1, you shared a letter on Reddit’s blog “Remember the Human – Black Lives Matter”. In this letter, you claim “as Snoos, we do not tolerate hate, racism, and violence, and while we have work to do to fight these on our platform, our values are clear.”
As of today, neither you nor any other Reddit admins have shared this letter anywhere on reddit.com. However, the response to this message was swift on Twitter, where you were rightfully labeled as hypocritical based on your long and well-recorded history of defending racism and white supremacy on this site.
Among the many responses was this message from former CEO of Reddit, Ellen Pao.
I am obligated to call you out: You should have shut down the_donald instead of amplifying it and its hate, racism, and violence. So much of what is happening now lies at your feet. You don't get to say BLM when reddit nurtures and monetizes white supremacy and hate all day long
Many others shared links and screenshots of your past statements saying “Open racism and slurs are fine to post on Reddit”.
The problem of Reddit’s leadership supporting and providing a platform for racist users and hateful communities has long been an issue. Nearly six years ago, dozens of subreddits signed the original open letter to the Reddit admins calling for action. While the Reddit admins acknowledged the letter and said it was a high priority to address this issue, extremely little has been done in the intervening years.
On June 5, you shared this update on /Announcements, Upcoming changes to our content policy, our board, and where we’re going from here. In the post, you stated that there is a need for continued adjustments of Reddit’s content policy to address racism and that this remains a priority. These continued statements that you hear us, that this is a priority, or that you are working on it are not enough. It has been five years since your return as CEO and this still remains Reddit’s most glaring problem.
Steve, if you and Reddit genuinely care about the values of standing up to racism and hate, then you need to back it up with real action. As moderators on this website who have dedicated countless hours to keeping this site running, we call on Reddit to take the following steps:
At /AgainstHateSubreddits, we have laid out the many failures of Steve time and again to stand up to white supremacy on this site time and time and time again.
With a website with the impact of Reddit on the broader conversations being held in communities around the world, this website needs real leadership and real action.
We hope that Reddit will not just share empty platitudes — but will take a meaningful stand against hate, and take these recommendations to heart.
This letter is co-signed by more than 200 300 350 430 550 650 800 communities representing well over 200 hundreds of millions of subscribers:

2020.09.24 20:03 nevermore-evermore $2000-$2500 miniITX or microATX Gaming & Illustration PC

What will you be doing with this PC? Be as specific as possible, and include specific games or programs you will be using.
Games like FFXIV, Witcher 3, Borderlands, and other AAA titles as well as indie games.
Also for illustration working with large files using software like Clip Studio Paint, Adobe Photoshop, and Adobe Illustrator.
What is your maximum budget before rebates/shipping/taxes?
$2000-$2500. Trying to leave some room for laboservice fees (not planning to build myself)
When do you plan on building/buying the PC? Note: beyond a week or two from today means any build you receive will be out of date when you want to buy.
Within the next week or so.
What, exactly, do you need included in the budget? (ToweOS/monitokeyboard/mouse/etc)
Tower and OS. Monitor recommends would be appreciated but can be outside of the budget.
Which country (and state/province) will you be purchasing the parts in? If you're in US, do you have access to a Microcenter location?
California, US. I can get to the LA Microcenter location.
If reusing any parts (including monitor(s)/keyboard/mouse/etc), what parts will you be reusing? Brands and models are appreciated.
HP S2031 and Acer H233H as well as cheap keyboard and mouse. Planning to replace the monitors, though.
Will you be overclocking? If yes, are you interested in overclocking right away, or down the line? CPU and/or GPU?
Not interested.
Are there any specific features or items you want/need in the build? (ex: SSD, large amount of storage or a RAID setup, CUDA or OpenCL support, etc)
SSD and at least 2TB of storage needed.
Do you have any specific case preferences (Size like ITX/microATX/mid-towefull-tower, styles, colors, window or not, LED lighting, etc), or a particular color theme preference for the components?
ITX or microATX is necessary. No window panel, no LED lights. Looking for a more industrial feel. My current build uses a SilverStone SG05 case and I wouldn't want to go much larger than that, though the shape can be different.
Do you need a copy of Windows included in the budget? If you do need one included, do you have a preference?
Windows 10
Extra info or particulars:
As I mentioned, not planning to build myself, so I'm hoping for something that'll be around $2500 after labor and parts not including tax. Also, for any possible monitor recommendations, reliable colors are very important to me.

2020.09.24 15:14 vetamit Medical Marijuana Implementation in the State of Arizona

I wouldn't be a good attorney unless I prefaced this article with a few disclaimers: 1) Marijuana is still a controlled schedule I substance and is illegal in the eyes of the Federal Government of the United States; 2) This article is not to be construed as legal advice, nor is intended to take the place of the advice of an attorney, and you should consult with an attorney before taking any actions in furtherance of the subject matter of this article. Ok, let's begin.
In the month of November, the State of Arizona passed Proposition 203, which would exempt certain people from controlled substances laws in the State of Arizona. However, it will still take some time before medical marijuana is implemented as policy in Arizona. The Arizona Department of Health Services has released a proposed timeline for the drafting of the rules surrounding the implementation of Proposition 203. So far, these are the important time periods that should be paid close attention to:
December 17, 2010: The first draft of the medical marijuana rules should be released and made available for comment on this date.
January 7, 2011: This will be the deadline for public comment on the first draft of rules mentioned above.
January 31, 2011: The second draft of the rules will be released on this date. Once again, it will be available for informal comment as in the draft referred to above.
February 21 to March 18, 2011: More formal public hearings will be held about the proposed rules at this time, after which the final rules will be submitted to the Secretary of State and made public on the Office of Administrative Rules website.
April 2011: The medical marijuana rules will go into effect and be published in the Arizona Administrative Register.
It is important that at all times throughout the consultation process, interested parties submit briefs and/or make oral presentations when permitted. Groups with interests contrary to those of medical marijuana advocates may also be making presentations, and may convince the State to unnecessarily restrict the substance or those who may qualify to access it if there is no voice to advocate in favor of patients' rights.
Some key points about Proposition 203's effects
-Physicians may prescribe medical marijuana for their patients under certain conditions. "Physician" is not defined in a way limited to normal medical doctors. Osteopaths licensed under Title 32, Chapter 17; naturopaths licensed under Title 32, Chapter 14; and homeopaths licensed under Title 32, Chapter 29 may all be eligible to recommend marijuana for their patients.
-In order to be prescribed medical marijuana, a person must be a "qualifying patient." A qualifying patient is defined as someone who has been diagnosed by a "physician" (as defined above) as having a "debilitating medical condition."
-Debilitating medical conditions include: • Cancer, glaucoma, HIV positive status, AIDS, hepatitis C, amyotrophic lateral sclerosis, Crohn's disease, or agitation of Alzheimer's disease or the treatment of these conditions. • A chronic or debilitating disease or medical condition or its treatment that produces one or more of the following: Cachexia or wasting syndrome; severe and chronic pain; severe nausea; seizures, including those characteristic of epilepsy; or severe and persistent muscle spasms, including those characteristic of multiple sclerosis. • Any other medical condition or its treatment added by the Department of Health Services pursuant to Section 36-2801.01.
This last qualifying condition is underlined because it is vitally important during the rulemaking process. Although Proposition 203 allows for the public to petition the Department of Health Services to exercise its discretion to add conditions under this section, bureaucracy is notoriously difficult to get to change any law. The initial discretionary rules for additional treatments could be exercised during the public consultations that occur between December and March, though this is not certain.
It is therefore important that, in the event that the addition of medical conditions is considered during the consultations, any stakeholder who wishes for a medical condition not listed in the first two bulleted items above to lobby during the public consultation periods for the Department to add the additional medical condition to the list of debilitating medical conditions. In order to increase the prestige of any presentations made to justify adding medical conditions under Section 36-2801.01, it may be helpful to solicit the testimony of sympathetic Arizona-licensed medical doctors who can testify on paper and at the public hearings about why the proposed condition should be added. Documents showing that other jurisdictions, both in the United States and elsewhere, currently use marijuana as a treatment for the proposed condition may be helpful, as would medical journals on the subject.
It should be remembered that despite his cheery YouTube videos about the medical marijuana rule drafting process, Director of Health Services Will Humble wrote a submission in opposition to the passing of Proposition 203. He did so on the grounds that the FDA does not test the drug, and even though the federal government's anti-marijuana policy is well-known it should not be relied on as an authority for unbiased medical marijuana research. There is no reason to believe that Director Humble will be any less inclined to obstruct the use of medical marijuana during the rulemaking stage, and all proponents of medical marijuana should be sure to make their voices heard at the consultations to prevent the obstruction of the intent of Proposition 203.
Extent of Rulemaking during Consultations
There are other provisions in Proposition 203 which will be discussed during the initial rulemaking process, and they will probably be the main focus of the consultations. The consultations will create rules: • Governing the manner in which the Department of Health Services will accept the petitions from the public previously mentioned, regarding the addition of medical conditions to the list of the already enshrined debilitating medical conditions. • Establishing the form and content of registration and renewal applications submitted under the medical marijuana law. • Governing the manner in which the Department will consider applications for and renewals of medical marijuana ID cards. • Governing the various aspects around the newly legalized nonprofit medical marijuana dispensaries, including recordkeeping, security, oversight, and other requirements. • Establishing the fees for patient applications and medical marijuana dispensary applications.
The most crucial part of the consultation period will be regarding the rules governing the establishment and oversight of medical marijuana dispensaries. If interest groups lobby the Department to make the recordkeeping, security, oversight, and other requirements around dispensaries too restrictive, it will have the effect of reducing the availability of medical marijuana to patients and driving up the price of medical marijuana due to the lack of supply. It could simply become too costly to comply with all of the regulations.
During this stage, it is important that stakeholders-particularly medical marijuana dispensaries from out-of-state, and perhaps pharmacists with a bit of economic knowledge-submit briefs explaining why certain proposed rules may have a negative effect on the patients this Proposition is supposed to help. The proposed rules have not come out yet, but when they do, they should be closely scrutinized for the possible negative impact that unnecessarily tough security and recordkeeping on nonprofit dispensaries might have on patients.
The other major factor in the rulemaking will have to do with the fees. The Department will be setting fees for medical marijuana dispensaries during the consultation period. Proposition 203 provides that the fees may not exceed $5,000 per initial application, and $1,000 per renewal. However, with some lobbying during the public consultation, it is possible that the actual fees will be much less since these are simply the maximum that the Department may charge.
Discrimination against Medical Marijuana Users
Under Proposition 203, discrimination against medical marijuana users will be prohibited in certain circumstances. Based on our analysis, a person may not:
• As a school or landlord, refuse to enroll someone or otherwise penalize them solely for their status as a medical marijuana cardholder, unless not doing so would result in the loss of a monetary or licensing related benefit under federal law or regulations. • As an employer, discriminate against hiring someone, or terminate them or impose any conditions on them because they are a medical marijuana cardholder, unless not doing so would result in the loss of a monetary or licensing related benefit under federal law or regulations. Employers may still terminate employees if the employee is in possession of or impaired by marijuana on the premises of the place of employment or during the hours of employment. • As a medical care provider, discriminate against a cardholder, including in matters of organ transplants. Medical marijuana must be treated as any other medication prescribed by a physician. • Be prevented, as a cardholder, from having visitation custody or visitation or parenting time with a minor, unless the cardholder's behavior "creates an unreasonable danger to the safety of the minor as established by clear and convincing evidence." Although there are certain prohibitions on discrimination, there are also provisions which permit discrimination against medical marijuana cardholders: • Government medical assistance programs and private health insurers are not required to reimburse a person for their medical marijuana use. • Nobody who possesses property, including business owners, is required to allow medical marijuana on their premises (this seemingly includes landlords who, although they cannot refuse tenants based on their being a cardholder, are permitted to prevent cardholders from bringing marijuana onto the landlord's property). • Employers are not required to allow cardholders to be under the influence of or ingest marijuana while working, though the presence of marijuana in the body which is not of a sufficient concentration to cause impairment does not establish being under the influence of it.
Rules Related to the Establishment of Dispensaries
Although the final rules around security, recordkeeping, and other requirements for medical marijuana dispensaries will not be established until April 2011, there are certain requirements which are enshrined in Proposition 203 itself and can be known ahead of the time that the final rules come out. These minimal requirements may not be as restrictive as the final requirements which are published in April 2011.
• Medical marijuana dispensaries must be nonprofit. They must have bylaws which preserve their nonprofit nature, though they need not be considered tax-exempt by the IRS, nor must they be incorporated. • The operating documents of the dispensaries must include provisions for the oversight of the dispensary and for accurate recordkeeping. • The dispensary must have a single secure entrance and must implement appropriate security measures to deter and prevent the theft of marijuana and unauthorized access to areas containing marijuana. • A dispensary must not acquire, possess, cultivate, manufacture, deliver, transfer, transport, supply, or dispense marijuana for any purpose other than providing it directly to a cardholder or to a registered caregiver for the cardholder. • All cultivation of marijuana must take place only at a locked, enclosed facility at a physical address provided to the Department of Health Services during the application process, and accessible only by dispensary agents registered with the Department. • A dispensary can acquire marijuana from a patient of their caregiver, but only if the patient or caregiver receives no compensation for it. • No consumption of marijuana is permitted on the property of the dispensary. • A dispensary is subject to reasonable inspection by the Department of Health Services. The Department must first give reasonable notice of the inspection to the dispensary.
Comparison to California's Medical Marijuana Law
The Arizona law is by no means the same as the law in California. There are certainly some differences between the two, though in some respects they are comparable. This is a comparative analysis of the two laws.
Similarities: Both laws, as a practical matter, allow for broad discretion on the part of a physician to prescribe marijuana to patients who suffer from pain. In the Arizona law, "severe and chronic pain" is the legislated standard. In the California law, any "chronic or persistent medical symptom" that substantially limits the life of the patient to conduct one or more major life activities as defined by the Americans with Disabilities Act of 1990, or that if not alleviated, will cause serious harm to the patient's physical or mental safety, qualifies. • Both laws have a number of illnesses which are automatically considered qualifying illnesses for the prescription of medical marijuana. These include, but are not limited to, AIDS, cachexia, cancer, glaucoma, persistent muscle spasms, seizures, and severe nausea. • Both laws require the use of an identification card by those who have been prescribed medical marijuana, after the cardholders have gone through an initial application process in which the use of the drug has been recommended by a physician. • Both states do not factor in the unusable portion of the marijuana plant in determining the maximum weight of marijuana that is permissible for possession by a cardholder.
Differences: Though the rules have not been finalized, the Arizona law appears as though it will be regulated on the state level and therefore uniform across Arizona. The California law, however, is regulated significantly on the municipal level, and therefore the rules around dispensaries can vary greatly from one municipality to the next. • The Arizona law provides a broader spectrum of people who are considered a "physician" for the purpose of prescribing medical marijuana. In California, only medical doctors and osteopaths are considered to be physicians. In Arizona, in addition to medical doctors and osteopaths, naturopaths and homeopaths will also be permitted to prescribe medical marijuana. • In California, patients or their caregivers may grow marijuana plants in lieu of using a medical marijuana dispensary. In Arizona, patients may only grow marijuana or designate someone else to do so in lieu of visiting a dispensary on the condition that there is no dispensary operating within 25 miles of the patient's home. • The maximum possession limit for marijuana in California is eight ounces per patient, whereas the limit is only 2.5 ounces per patient in Arizona.
-This is not meant to be legal advice and is provided purely as an analysis of the current legislation. You should consult with an attorney to discuss these matters. We are available for consultations for this matter by appointment only and via prepayment of the consultation fee.

2020.09.24 12:10 Jonah_Esco I’ve been having a hard time with my family

I’m a 14m with a big family. I have 6 siblings, (these aren’t their real names) an older half-brother, I’ll call him Orion(21), an older half-sister, I’ll call her Lisa(18), and 4 little brothers, I’ll call them Henry(12), Daniel(10), Gavin(8), and Austin(5). My father is an airman, and my mum is an employee for Amazon customer service.
When I was nine, my parents would go out a lot, so Orion was in charge a lot, but Orion was allergic to a lot of the food we had, so I had to make sandwiches for my little brothers almost everyday. Usually Orion, Henry, Daniel, and I would mess around and wrestle with each other, so most of the time I hit one a little too hard on accident (I didn’t know how to hold back on my punches back then) and because of that I would be sent up to my bed, unable to get food or water for hours, because my parents would stay out till late in the evening. And the more that happened, the more I started hating Orion, and the more I felt like my parents were neglecting me, even though I told them countless times what had happened. All because of that I started to get anger issues and became extremely skinny.
Fast forward a year and a half, we’ve move from California to Virginia, Orion finished high school, and I’m now 11. I’m usually chill and calm, but as soon as I get a bit angry, I burst, but the thing is my anger isn’t at it’s worst. Orion and my mum would argue almost once a week, and I’d be right outside the room they are arguing in. As my parents usually do, they go out a lot. But after almost 4 months of my mum and Orion arguing, Orion leaves and goes to Florida, and that’s when my anger finally bursts out.
I had been calm until he left. Part of me was happy he left, but the other part was angry he got to do so much to me and it just gets brushed under the rug. At this point my parents would go out a little less and Lisa and I would be put in charge a lot more. Lisa was 16, so she decided to get a job, and I’d be in charge more often. My brothers would always treat me poorly though, so every time they could, they’d try to anger me and get me in trouble.
Another year and a half passed and my mum finally put me in anger management therapy and I started to get better at controlling my anger, even though I do burst occasionally. But I only went for 4 months, because then quarantine started and I couldn’t get any appointments. Lisa was jumping from a few jobs before deciding to work at dominos in January. My mum stopped going out as much, my dad got a new car after his old one broke down completely, and Lisa and my mum’s relationship began to get worse. In 3 months, it went from arguments about their jobs, to arguments about Lisa’s boyfriends. (By now she’s dated 4 guys at different times, broken up with all of them, and met a new guy she’ll soon move in with.) Every time they would fight I’d try to stop them but I couldn’t, and one day about 2 months ago from today, Lisa just left and started living in her friend’s house. Since then I’ve been trying to fix my sleep schedule, work on my more chores than I previously had, fix my relationship with my brothers, and cope with the amount of stress Lisa left me with. I’ve had my first 5 panic attacks since then.
A couple weeks ago, my parents started to get a lot harder on me with all the chores I have to do (while I’m still trying to fix my sleep schedule from 4am-12pm to 10pm-5am) and they haven’t really been supportive of me. I’ve been trying to tell them that my mum has been extremely negative, and my dad has been really hard on me while I’m still trying to fix a lot of my current problems.
What should I do? I’m not sure how I’m supposed to explain all this I’ve been bottling up for the past 2 months.
TL;DR, I started having anger issues because of my older brother and it started messing with my relationship with my family, my brother leaves and my anger issues get worse. A year and half later, I start therapy for my anger. A few months after quarantine starts, my sister leave, making me the oldest child in the house and I’m trying to fix most of my problems, meanwhile my parents are expecting a lot from me after only 2 months of me being the oldest.

2020.09.24 06:28 memesandcommunism LETTER TO REDDIT CEO

Open Letter to Steve Huffman and the Board of Directors of Reddit, Inc– If you believe in standing up to hate and supporting black lives, you need to act

2020.09.24 04:08 greycar99 I am getting top surgery in a month-ish and I found out yesterday!!!

I just really want a place to write everything out because I know I liked reading these when I was searching for answers. So I have been out for 6 years, on T for 3 years, name changed for almost 2 years, and getting top surgery at the end of October. I have known I have wanted surgery for as long as I have realized I am trans. (oh I am 20 almost 21 btw) I got on T a few months before I turned 18 but I have always tried to figure out how to get surgery but money has always been an issue. I have been saving for it seems like ever and so in May I decided to find a therapist who could write my letter.
I found a lady I really like and I am still seeing her. It's all online and she's super nice and supportive. I started seeing her on 5/15/2020 and on 6/12/2020 she wrote my letter. Out of looking at what feels like every surgery result on the internet, I decided to go with Dr. Mosser in California. From YT videos he seemed to have the best bedside manner (which is really important to me because I want to feel comfortable ya know?) and I loved his results. His website too is...wow. Literally, everything you could possibly need is on there and I like that you do not have to go searching for answers. So I emailed them my letter, my insurance card (bc I wanted to see if insurance would cover it), and a picture of my ID on 6/16/2020 and then called them on 6/17/2020. When I called the lady that schedules stuff was busy but they called back within the hour and the next consult date was AUGUST FREAKING 26TH. I was sort of heart broken but he's becoming a more popular surgeon and if I had waited this long I can wait 70 more days.
I had to submit pictures of my chest as well. I was really nervous about this and the only person I felt comfortable asking was my mom and she's my biggest cheerleader but I know surgery talk makes her kind of uncomfortable. I asked her and she was fine with it and it really wasn't as awkward as I thought it would be. I submitted those pictures to the website thingy and waited.
A week before my consult, I had moved in at college and it was before classes had started so I was wandering around campus, and my phone rings. And it said "Dr. Mosser's Office" I swear I almost pooped my pants. I thought I had messed up the date and I wasn't close to my dorm, I didn't want random people on campus to hear me! Turns out I got an email from a lady from his office saying she was going to call and confirm my information but it got sent to my spam and I didn't see it until after. She basically just asked what meds I was on, if any, weight, just confirming stuff lol. It didn't take long but it sure scared the crap out of me.
August 26th came and I was so freaking nervous. I was at my grandparent's house pacing waiting because they said he would start calling patients at 9:45 PST but I live on the east coast so it was 12:45 my time and I was so IMPATIENT!!! When my phone finally rang, I literally just stared at it for a minute. I didn't know what happened but it honestly was like 10 seconds but it felt like 8 years and running down the hallway at my grandparents to close myself in the computer room so they wouldn't hear.
It literally was a 5-minute phone call but this man was so nice. He asked what did I expect from the surgery and what I wanted my chest to look like and it was just really nice. Later that day I received an email from his office saying they had submitted all of my notes from the consult with the other stuff I had provided to my insurance and it could take up to 4-6 weeks to hear anything and if they denied we could appeal and after the 2nd appeal insurances normally said yes. That scared the crap out of me. I know my insurance covers surgery and he's partnered with BlueCross Blue Shield so I knew they would approve it but the question was in-network or what level of out of network.
I have been just waiting since then. It sucks. At least when you have a date, you have something to look forward to but just aimlessly waiting SUCKS. On Tuesday's, I don't have a lot going on. So I woke up yesterday 9/22/2020 around 10 am and went to the bathroom because I was about to pee my pants and had all plans to go back to sleep because I was tired. I got up and sat at my desk to check my email because I was waiting on one from my professor. My phone rings and it's from an out of state number but not California and I normally wouldn't answer but I felt inclined to. It's this lady "I am from *my insurance* and I am calling you today to talk about your benefits" I almost interrupted her to be like "ma'am my mom holds the policy not me" but then she says "I am here to discuss your recent claim for benefits" and then it clicked. Holy crap this was about surgery and it hadn't even been 4 weeks. She finally said "oh you've been approved for surgery" and I DIDN'T KNOW!! and she was like "well congratulations, they have tentative dates in here from October 29th to January 29th, 2021." excuse me WHAT?! She gave me my case number for approval and her phone number if I had any more questions and I was in shock. This random fricking Tuesday, I just wanted to go back to sleep but I was too amped up to even think about sleep!!!
It was like 10:30 at this point and Dr. Mosser's office doesn't even open until noon my time and I had class at 1:15. I didn't think it would take longer on the phone but I didn't want to call them immediately when they opened so I waited until after class at 2:30. I got back to my room and I called. They comfirmed I had been approved and then transferred me to the scheduling lady. When I had my consult, Dr. Mosser told me they were hiring another surgeon soon and that would cut down on the wait time. The lady was telling me dates for Dr. Mosser and the earliest he had was in June of 2021. Then she said the other doctor, Dr. Facque (fake-way) had avaliablity at the end of October and through October, Dr. Mosser would be in the operating room as well. I was in shock again and asked if I could call back to schedule and she was like "of course." so I called my mom (she is the one going with me to California) and did some googling and called back. I picked the end of October date and then we set up my other appointments: a virtual pre-op in early Oct which is also the payment deadline, my in person pre op 2 days before surgery, my surgery date, and my post op to get drains out date and time. Since Dr. Facque is still new to the practice, he did not have a schedule yet of when he would be in the office so she said she would call me back in 2 hours after talking with him to make sure the appointment times for pre-op would be okay. In that time, I found an Airbnb VERY close to their office and booked my plane tickets. Literally not what I expected on that morning when I woke up about to pee myself but I am not complaining. Holy crap life doesn't feel real.
I swear I am having a good year only because I watched Phineas and Ferb as a new years' resolution.
She called back as she said and we confirmed the times and said Dr. Facque would call me tomorrow to have a mini-consult with him and he did call and he's super nice as well. I go by my middle name (it's a family thing) and almost at the end he goes, "wait, I might need to apologize, do you go by *first name* or *middle name*?" because he was calling me my middle name the whole time which is correct. And I tell him yeah I go by my middle name but that made me smile and I know I am making the right choice. The nice scheduling lady said she is going to call tomorrow to make sure I want to go forward with Dr. Facque after the call tonight and I definitely do.
Holy crap, this is literally happening so fast. I have never had surgery, never been on a plane, never spent this much money, or even planned my own trip before and I am about to have major surgery and go on 4 planes within two weeks of each other. I also contacted Disability Services at my school and they just need a letter from my surgeon with the date and recovery plan for them to send an email to my professors. Most of my stuff is online and I am ahead in 2 of my 5 classes. I am more concerned about deadlines and stuff because I know I will not want to do anything that week I am in California nor do I want to push myself too hard. My 8:30 am class will temporarily become my 5:30 am class so ... yeah. At least they are already recorded because of the pandemic lol. I am so excited and so ready for this. I will feel better when everything falls into place with school and work. Oh, I do not even want to think about work right now. I work retail and just transferred locations because I just started college and so I do not even know these people, I am stealth, and I have to request a large amount of time off when I already only work weekends...I am not an asshole but I sure feel like one. Literally less than 40 days now...what the heck is life? Please comment any question and I will be willing to help if I can. I know I liked reading these things to know what to expect but could never find many so I hope I am helping some kid out there. 2020.09.24 02:34 chatlunatique Follow-up: Potential match for Hawaii Jane Doe (found living, died 2013)

A few weeks ago, Johnjoishere (can't tag, sorry) posted about a Hawaii living doe who died in 2013. I'm making a new post here for follow-up discussion on a potential match to Sheila Lopes, a missing California woman.
This match may seem a bit of a long-shot, but there's just some overlapping attributes and inconsistencies with reporting that I believe merit a comparison.
FYI: I go into a bit of detail after the table about the comparisons, then dive into oddities about each woman in the longer part. Feel free to skip that if you want to keep discussion solely on the ID match.

Sheila Ann Lopes Hawaii Jane Doe (HJD)
Date Last Contact / Found 08-28-2008 04-27-2013
Location Escondido, CA Honolulu, HI
Age 71 55-65
Height 5'6 5'5 - 5'7
Weight 135 lbs 112 lbs
Hair / Eyes Grey / Blue Hazel / Hazel
Features Abdominal C-section scar. Face lift scar behind - L ear and R ear. There are no autopsy/physical notes provided for Hawaii Jane Doe.
Additional Notes Lopes suffers from Alzheimer's Disease and is considered a dependent adult as a result. She'd been having symptoms of the illness for about five years by 2008. She is mostly lucid, however, and she's in good health physically. She smokes cigarettes. She is originally from London, England and speaks with a slight British accent. She was schizophrenic and described as being very proper and having an English Canadian-like accent. She was an avid reader and was a smoker. She referred to herself as "Ah," with the sound being the "a" as in the pronunciation of the word "agreement."
Circumstances Charley Project: Lopes disappeared from her home in the 2100 block of Woodland Heights Glen in the 481-acre gated community of Emerald Heights in Escondido, California on August 28, 2008. Her husband saw her at home at about midnight. At 10:30 a.m., she wandered into a home where her son used to live, about a twenty-minute walk away, and the new owner told her to leave. The owner called the police that afternoon, after she realized Lopes was missing. She has never been heard from again.Lopes's niece's puppy was found on a nearby hill after Lopes vanished. It's possible she was taking the puppy for a walk early in the morning and got lost. She had wandered away from home before, but never for longer for several hours at a time. Her family planned to buy her a tracking device to wear, but she disappeared before they could get one. She is thought to have left on foot, as she has no access to a vehicle. An extensive search of the neighborhood turned up no sign of her. The Emerald Heights community has security cameras at the only entrance gate, but the cameras didn't film her leaving. Her case remains unsolved. Doe Network: "The unidentified, homeless woman was located living in Ala Moana Park. She was in need of medical attention and could not walk due to lack of strength. She was admitted into a state hospital where she received treatment until her death on April 27, 2013. Based on investigative conversations with local social service organizations, she had probably been in Hawaii for six to eight years prior to her discovery." NAMUS: "It is believed that she has been in Hawaii since 1994."
Clothing A gray cotton two-piece sweatsuit, a long-sleeved zippered teal-green shirt and matching pants, white canvas slip-on deck shoes, a gold bracelet on each wrist, a diamond wedding band, and a black pearl ring on her left hand. n/a
Images Pic 1, Pic 2 (~2008), Pic 3 Pic 1, Pic 2, Pic 3
NAMUS MP35144 UP15918
Rule Outs None None
Points of Comparison
I think there are physical consistencies between the two women, as well as some resemblance in facial features. The brow ridge and shape were what first caught my eye. Considering the impact that climate and aging can have, I also think there could be some similarities in nose shape (esp. HJD Pic 3 with Lopes' license pic).
After the eyebrows, the second point that stuck in my mind was that both are described as having a light British-ish accent.
Then there's HJD's schizophrenia, which I can imagine could be easily misdiagnosed for Alzheimer's.
Match Problems / Oddities
Dates could make/break this match. I don't know where the 1994 estimate comes from on NAMUS, but I just don't think this woman looks like she's weathered 20+ years in Hawaii. If we run with the 6-8 year estimate, then she'd be solidly in the range of Lopes' disappearance.
Second, please examine the background of the Escondido missing flyer (also Lopes Pic #2). I don't think this looks like SoCal, but it does look a whole lot like Hawaii.
Third, and this is what just weirded me the hell out, is that Lopes' husband's middle name is listed as "Honolulu".
-------
If you want to keep reading, I'll jump into the other weird inconsistencies that make both cases frustrating to follow.
Hawaii Jane Doe (HJD)
So, Kauai PD estimates HJD has been in Hawaii since ~2005/2007 (Doe Network) or since 1994 (NAMUS). She's found alive in Ala Moana Park (just NW of Waikiki) at some unknown point in time and taken to a state hospital, where she lived until her death. But then is presumably found again, this time as unrecognizable decomposed/putrefying remains? She's also listed in NAMUS as found in Lihue, Kauai, which explains why Kauai PD--rather than Honolulu PD--has her case. It does NOT, however, explain the state of her remains, nor why she was taken to a Kauai hospital if her condition was so poor upon initial discovery. Kauai has a much smaller hospital (Wilcox, I assume) with a handful (like maybe 10 max) psychiatric / long-term care beds. Honolulu, on the other hand, has a MUCH larger capacity distributed across several large health systems. Wilcox is also not a state hospital. The only state-run psychiatric facility is in Kaneohe, which is (like Honolulu) on O'ahu.
Sheila Ann Lopes
I also want to note the differences between Lopes' missing circumstances on different databases. Above is what appears on her Charley Project listing, sourced from several news articles and the CA AG office.
NAMUS simply says:
On 8-27-2008 Missing person last seen in Escondido, CA. Missing person has Alzheimers Disease - but mostly lucid.
NAMUS also lists that her sweatsuit was entirely teal (vs. grey with a teal t-shirt).
The Escondido Police flyer, alternatively, says:
May be wearing teal-green long-sleeve shirt and teal-green pants, or possibly purple/fuchsia silk jacket with small print and purple/fuchsia velour pants, with white canvas deck shoes.
Doe Network also has the teal sweatsuit listed, and lists her missing circumstances as:
Sheila Ann Lopes was last seen by her family around midnight at her home on Woodland Heights Glen in Escondido, California where she lived with her husband. She got up in the middle of the night and walked out the back door. About 10 a.m. the next day, Lopes apparently walked into a nearby house where her daughter used to live in the gated Emerald Heights neighborhood.
The startled resident told her to leave. Lopes has wandered away before, but only in the neighborhood, and a neighbor would walk her back home. The neighborhood is perched on a mountain, and steep slopes lead down to Woodland Parkway in eastern San Marcos and northwest Escondido.
According to the San Diego Union Tribune's reporting, her son-in-law acted as the family spokesperson. He relayed that the family believed she woke up in the pre-dawn hours to smoke a cigarette and take the puppy for a walk. It is his home--one which he formerly shared with Lopes' daughter--that Lopes tried to mistakenly enter sometime between 10am-11am the next day.
I cannot find any additional reporting beyond 2008 or evidence that any other family member spoke with the press.

2020.09.23 22:26 GeoffSim Coercion to sign attendance (US-CA)

Pretty minor one, but an agency that provides therapy for one of my family members uses an app for us to sign to agree that they attended the session, presumably so they can in turn bill the relevant authorities correctly.
A supervisor occasionally visits, but also does work in her office. She wants me to sign for some work she did (program planning) in her office. The app has a checkbox that states "I verify that the services provided at this location, date, and time shown are true, correct, and complete."
Obviously I can't verify any of those things, but she says the "client services agreement" requires me to sign it. Is that coercion?
The signature box could fit wording like "I cannot verify this" but in all honesty I doubt anybody even looks at that. But it's hard to write something in a box on a phone.
Worst case scenario would be they decline to provide services any more, which wouldn't really be that bad a thing in all honesty. But I would like to know what kind of retort I could have besides "nope, not signing that".
Thanks.

2020.09.23 20:57 MikeSavad how do i get my refund?

i'm hoping someone more active on insta360 can help me.
i bought my ONE R on 9-11, it took 5 days to get, bought it from the website, had no idea it ships from china.
finally get it. it takes terrible photos.
jpgs are over saturated and blurry RAW are randomly in focus, some are plain out of focus, very dark, muddy colors the camera freezes randomly the PC doesn't recognize it i have issues with over heating i have issues with it not connecting to my phone (one plus 6t) it either can't find it or drops out, there is a lot of lag as well, so i can't use it as a button. and overall its a pain to use this camera, the interface is difficult, the workflow is annoying.
but mostly its not sharp.
i'm comparing the detail to other camera's with a ccd about the same size.
the site has a 14day policy:
*** Products purchased at Insta360 Store can be returned within 14 days upon receipt of the product without any reason. The product has to be in unopened-factory condition and Insta360 will only refund the full price of the product.
Insta360 Store will offer you an exchange should there is any quality issues with the product within 14 days from the date of the completed transaction. We will refund you should there is no exchange unit. We will also be responsible for any costs incurred during this type of exchange and refund.***
the first part makes no sense, you can't test a camera and return it while still in the box. that's Schrodinger thing.
but the second part says i can exchange or return it with a refund. the lady on the phone had no idea how it could be sent back because she says they don't send them back due to the open box thing. which again makes no sense. and based on the reviews that i'm going through much more thoroughly now, there seems to be 2 camps. people that LOVE the camera, people that HATE the camera.
the haters, have the same issues i have. so it tells me its a batch thing.
but here is the problem, i wrote to tech, they asked for pix, i sent some they said the images are normal. but they aren't in focus. i couldn't present them any where. its like it was painted on. then i never heard back from him.
ecommerce asked about a card, then never came back. i've been doing this for about 6 days now, waiting for answers that never came. the lady in california, said they will escalate it. but i got no email today either. i can't imagine what the delay could possibly be other than they are waiting for 14 days to pass, and i have no answer.
i want my money back, customer service is terrible. this camera is terrible, and i just want the refund. i put a call on the site to get a refund 5 days ago, and nothing is happening. why is this hard? how do i get my money back? i don't want this thing in my house any more.
thanks

2020.09.23 16:05 IllustriousProgram5 $SGMD ~ Sugarmade Takes Steps Toward Establishing Licensed Cannabis Cultivation in Northern California

Sugarmade Takes Steps Toward Establishing Licensed Cannabis Cultivation in Northern California
https://www.otcmarkets.com/stock/SGMD/news/Sugarmade-Takes-Steps-Toward-Establishing-Licensed-Cannabis-Cultivation-in-Northern-California?id=274950
NEW YORK, Sept. 23, 2020 (GLOBE NEWSWIRE) -- via NetworkWire – Sugarmade, Inc. (OTC: SGMD) (“Sugarmade” or the “Company”) is excited to announce the signing of a nonbinding Letter of Intent (the “LOI”) with LMK Capital, LLC (“LMK”). Sugarmade and LMK have agreed to work toward the negotiation of a definitive lease agreement for access to as much as 40 acres of property in Northern California. The Company intends to use 5 acres of the property to operate a regulated and licensed cannabis cultivation business. Jimmy Chan, Sugarmade’s chairman of the board, chief executive officer, chief financial officer and majority stockholder, is also majority owner of LMK.
“We continue to take strategic steps toward broadening our exposure to the growth trend in the cannabis market,” Chan commented. “We see this as a secular growth trend that is still very much in its early innings. And we believe our positioning in California puts us close to the current epicenter of that trend. In addition, we are committed to increasing verticalization of operations as a context for our investment in the BudCars cannabis delivery business. If we are able to finalize the lease, we expect that this could drive a substantial widening of margins on the growing volume of BudCars sales.”
Sugarmade has a 40% stake in BudCars, with the option to acquire an additional 30%. Because BudCars is a rapidly growing distribution channel, Sugarmade believes it will have a direct channel in the marketplace to establish its own branded cannabis product line, which can then be distributed through multiple distribution partners at premium pricing.
Sugarmade’s in-house analysis suggests that control over 5 acres of this property carries the potential to yield as much as 8,000 pounds (or more than 3,628,700 grams) of cannabis flower per year.
The LOI is nonbinding on the parties and there can be no assurance the parties will enter into a definitive lease agreement.
About Sugarmade, Inc. Sugarmade, Inc. (OTC: SGMD) is involved in the following two main business areas: (i) the supply of consumable products to the quick service restaurant subsector of the restaurant industry, and as an importer of nonmedical personal protection equipment to business and consumers, and (ii) investment in the Budcars licensed cannabis delivery service brand (“Budcars” or the “Budcars Brand”) and joint ownership and operation of Budcar’s first operating location in Sacramento, California.
